Florida court rules against police over pot arrests

A Florida appeals court is throwing out convictions against two men because sheriff’s deputies discovered pot plants by looking through a mobile home window.

 

State of Florida to take over crimes on cruises

Prompted by concerns from Port Canaveral Police Chief Joseph Hellebrand, new Brevard State Attorney Phil Archer said Tuesday he is willing to exercise the State of Florida’s jurisdiction to crimes that occur on ships when they are in waters beyond Florida’s three-mile limit.

 

Florida Governor speeding up death warrant process

Governor Rick Scott has accelerated the pace of signing death warrants in Florida by lining up three executions over the next few weeks, the most in such a brief period of time in more than two decades.

 

Scott Shoots Down Pasco Probation Takeover

Governor Rick Scott on Monday vetoed a bill that would have financed a closer look at a proposal for the Pasco County Sheriff’s Office to take over felony probation services in Pasco from the state Department of Corrections.

Miami Police Major Ian Moffett was appointed as the Miami-Dade Schools Police Department’s new chief at the Miami-Dade School Board meeting Wednesday.

 

Rockledge picks new police chief

Joseph LaSata, assistant chief of police for the West Hartford (Conn.) Police Department, has been selected as the new chief of police for Rockledge. He begins work there June 3.

 

Palm Beach Sheriff’s Office Rejects Merger with Schools’ Police

The Palm Beach County Sheriff’s Office says with the schools police department would bring additional costs they are not ready to absorb.

 

Panama Beach Police Enforcing “Leave No Trace”

The “Leave No Trace” ordinance is designed to keep beaches clean. Even though they will be working in a public capacity, Chief Drew Whitman says they are still police officers and if they see a violation they can write a ticket or make an arrest

U.S. Government Accountability Office:  Addressing Potential Security Risks of Foreign-Manufactured Telecommunications Equipment

The network providers and equipment manufacturers GAO spoke with reported taking steps in their security plans and procurement processes to ensure the integrity of parts and equipment obtained from foreign sources. 

 

U.S. Government Accountability Office:  Emergency Alerting Capabilities Have Improved, but Additional Guidance and Testing Are Needed

Since 2009, the Federal Emergency Management Agency (FEMA) has taken actions to improve the capabilities of the Integrated Public Alert and Warning System (IPAWS) and to increase federal, state, and local capabilities to alert the public, but barriers remain to fully implementing an integrated system. 

 

U.S. Government Accountability Office:  Preliminary Observations on Department of Homeland Security’s Overstay Immigration Enforcement Efforts

 Since GAO reported on overstays in April 2011, the Department of Homeland Security (DHS) has taken action to address a backlog of potential overstay records by reviewing such records to identify national security and public safety threats, but unmatched arrival records remain in DHS’s system.

 

Florida Department of Law Enforcement:  Crime in Florida — Uniform Crime Reports, 2012

The number of crimes reported by law enforcement in Florida declined 6.5 percent from 2011 to 2012. Overall, violent crime decreased 2.4 percent from 2011 to 2012, however the number of homicides increased by 2.4 percent and forcible sex offenses increased by 2.7 percent. Non-violent crimes decreased by 5.9% from 2011 to 2012. The number of arrests by Florida law enforcement increased by .8 percent over the previous year, resulting in 960,192 reported arrests in 2012.

 

U.S. Department of Justice Bureau of Justice Statistics:  Jail Inmates at Midyear 2012 – Statistical Tables

After three consecutive years of decline in the jail inmate population, the number of persons confined in county and city jails (744,524) increased by 1.2% (or 8,923 inmates) between midyear 2011 and midyear 2012. Rated capacity in jails, the number of beds or inmates assigned by a rating official to a facility, reached 886,947 beds at midyear 2012, an increase of 0.8% (7,225 beds) from 879,722 beds in midyear 2011. Local jails admitted an estimated 11.6 million persons during the 12-month period ending June 30, 2012, which was similar to 2011 (11.8 million) and down from 13.6 million in 2008.

 

U.S. Department of Justice Office of Juvenile Justice:  Guidance to States–Recommendations for Developing Family Drug Court Guidelines

Rapidly growing across the nation, family drug courts provide an effective response to serving high-risk families affected by substance abuse and child maltreatment. Well-functioning family drug courts bring together substance abuse treatment, mental health, and social services agencies to work with the court and attorneys to meet the diverse needs of these families. The courts also provide intensive judicial monitoring and interventions to treat parents’ substance use disorders and address their effects on children. Based on the results of a national review of family drug court policies and practices, and relevant research literature, the new guidelines provide a roadmap for states and local jurisdictions to implement evidence-based practices in family drug courts.

 

Early Victim Engagement in Domestic Violence Cases, Final Report

This report presents the findings and methodology of an evaluation of New York City’s Early Victim Engagement (EVE) Project, which was launched in 2008 to contact by telephone victims of intimate partner violence immediately after a defendant in the case is arraigned in criminal court. The evaluation produced three major findings. First, when EVE staff members called primary complaining witnesses in these cases, they reached approximately 80% of them and scheduled appointments with 57% of them. Second, when EVE staff scheduled appointments for witnesses, 71% of witnesses came in to the district

 

Vera Institute of Justice:  Building Cost-Benefit Analysis Capacity in Criminal Justice–Notes from a Roundtable Discussion

As state and local budgets have become increasingly strained in recent years, interest in using cost-benefit analysis in criminal justice policymaking and planning has grown.  Although reliable information on costs and benefits can help guide budget officials, policymakers, and legislators, most jurisdictions have not been able to create a sustained capacity to either conduct cost-benefit studies or use their results.   This report summarizes a Cost-Benefit Knowledge Bank roundtable discussion, which examined factors that might help agencies draw on cost-benefit analysis in a lasting, meaningful way. In the daylong meeting, people from state policy entities and nonprofit organizations, along with elected officials from four states, discussed strategies for building cost-benefit analysis capacity.  This publication covers three areas to consider as part of that objective: organizations, staff, and making cost-benefit analysis part of ongoing processes.  To support jurisdictions’ efforts to build their cost-benefit analysis capacity, participants recommended increasing the pool of people who have cost-benefit analysis skills by providing more training in graduate level criminology programs, increasing access to data about costs in the criminal justice system by publishing marginal cost information, increasing the amount of-and access to-information about program outcomes, and highlighting decision makers-such as legislators, agency heads, and budget officials-who use cost benefit information in policymaking and planning.

The Florida Police Chiefs Association, in cooperation with the Florida Criminal Justice Executive Institute, has scheduled an Advanced Future Law Enforcement Executives Seminar from August 19 – 23, 2013, at the Embassy Suites Lake Buena Vista in Orlando, Florida.  This training is structured as a sequel course for graduates of the FPCA/FCJEI’s Future LE Executives Seminar or for those who have been in a command position for three or more years.  For more information, click here.

REGULATORY UPDATE

 

Juvenile Justice Staff Training Waiver Sought by Pasco Sheriff’s Office

On May 14, 2013, the Florida Department of Juvenile Justice Division of Staff Training received a petition for permanent waiver of Rule Chapter 63H-1, entitled “Basic Curricula,” which establishes Protective Action Response (PAR) as the required method of verbal and physical intervention techniques and mechanical restraints in juvenile programs and facilities. The Pasco Sheriff’s Office, which staffs the Pasco Juvenile Assessment Center, cites economic hardship if all of their CJSTC-certified staff must also be PAR-trained in order to staff the facility.
