Florida DFS Rule Development Workshop Report: Civil Remedy Document Filing Procedures

The Florida Department of Financial Services (“DFS”) Division of Consumer Services held a Rule Development Workshop on proposed Rule 69J-123.002 relating to document processing of civil remedy proceedings filed against insurers.  

DFS Assistant General Counsel Tom Valentine and Chief of Education, Advocacy and Research Greg Thomas presided over the workshop, which generated minimal discussion.

The proposed Rule amendment would resolve the issue of paper document processing by requiring all material filed with the DFS relating to a civil remedy proceeding to be transmitted electronically, such as an insurer’s report of disposition and other communications.  Electronic filing of civil remedy notices already is required by the DFS.

The record will remain open for seven days until Monday, June 29, 2009 at 5:00 p.m.  Additional written comments may be submitted until the deadline, after which a Rule Development Hearing will be scheduled.
