CALENDAR: Insurance-Related Florida Legislative Interim Committee Meetings–October 5-9

The Florida Legislature will hold the first Fall 2009 Interim Committee Meetings during the week of October 5-9.  Additional Interim Committee Meetings will be held during the weeks of November 2-6 and December 7-11.

Monday, October 5

 

Florida Joint Administrative Procedures Committee Mandatory Rulemaking Meeting

The Florida Joint Administrative Procedures Committee (“JAPC”) will meet on Monday, October 5 from 4:00 p.m. through 6:00 p.m. in Room 301 of the Senate Office Building, The Capitol, Tallahassee.  Among its oversight responsibilities, the JAPC, a legislative committee, reviews all bills signed into law each year for mandatory rulemaking content.  In regard to mandatory rulemaking hearings, for those laws that the JAPC procedurally has determined a lack of agency regulatory implementation, the agency secretary is invited to attend the hearing to explain why the mandated rules have not been effected.

Rulemaking for the following insurance-related laws is scheduled to be reviewed at the October 5 meeting:

  • Mandatory Rulemaking:  Department of Financial Services
    • Chapter 2007-199 Relating to Insurance Representatives
      • HB 1381, signed into law by Florida Governor Charlie Crist in 2007, will authorize certain agencies designated as branch offices to file applications for registration in lieu of licensure.  The bill also provides exemptions from required written examinations to certain applicants for licensure as claims adjusters and authorizes certain licensed agents as the agent in charge of branch locations under certain circumstances.  The bill revises requirements for identification of insurers, agents and insurance contracts.
  • Mandatory Rulemaking:  Financial Services Commission
    • Chapter 2008-32 Relating to Health Insurance
    • Chapter 2008-178 Relating to Motor Vehicle Warranty Associations
      • Signed into law in 2008 by Governor Crist, the bill will exempt motor vehicle manufacturers applying for licensure as service agreement companies from certain licensing requirements and limit claims liabilities.  It also will prohibit warranty service associations that do not collect the names and addresses of warranty holders from denying a warrantyholder’s claim on the basis that the association cannot confirm that the warranty holder, in fact, purchased a warranty.

Florida Senate Committee on Community Affairs Meeting

The Florida Senate Committee on Community Affairs will hold an interim meeting on Tuesday, October 6 from 10:00 a.m. through Noon in Room 412 of the Knott Building, The Capitol, Tallahassee.  The following insurance-related item is scheduled to be discussed:

 

Florida Senate Committee on Banking and Insurance Interim Meeting

The Florida Senate Committee on Banking and Insurance will hold an interim meeting on Tuesday, October 6 from 1:00 p.m. through 3:00 p.m. in Room 412 of the Knott Building, The Capitol, Tallahassee.  The following insurance-related issues are scheduled to be discussed:

  • Presentation by Florida Insurance Commissioner Kevin McCarty, Florida Office of Insurance Regulation
  • Presentation by Susanne Murphy, Executive Vice President of Corporate Operations, Citizens Property Insurance Corporation
  • Senate Professional Staff presentation on the Florida Hurricane Catastrophe Fund

 

Wednesday, October 7

 

Florida Senate Committee on Finance and Tax Meeting

The Florida Senate Committee on Finance and Tax will hold an interim meeting on Wednesday, October 7 from 3:30 p.m. through 6:00 p.m. in Room 301 of the Senate Office Building, The Capitol, Tallahassee.  The following item of interest is scheduled to be discussed:

  • Single Sales Apportionment for Corporate Income Tax

2010 Regular Legislative Session Dates

  • August 1, 2009:  Deadline for filing claims bills
  • March 2, 2010:  Regular Session convenes
  • March 2, 2010:  Noon–deadline for filing bills for introduction
  • April 20, 2010:  50th Day–last day for regularly scheduled Committee meetings
  • April 26, 2010:  All bills are immediately certified; Conference Committee Reports require only one reading; motions to reconsider are made and considered the same day
  • April 30, 2010:  60th Day–last day of Regular Session
