Teacher Dismissal Policies Vary Among States, Education Commission of the United States Report Explains

The Education Commission of the United States has released a September 2010 report entitled “State Teacher Tenure/Continuing Contract Laws,” which compares the way Florida and other states handle the issue of teacher dismissal.

Applicable Florida law no longer incorporates uses the term “tenure.”  Meanwhile, other states have repealed their tenure provisions and tightened their timelines designed to afford teachers due process in dismissal proceedings.

While 19 states continue to use the term “tenure” in their teacher-related policy, a number of other states use “continuing contract” terminology which relates to the wording of teacher contracts.  During 2010, 11 states modified at least some element of their tenure or continuing contract policies.
