Proposed Rule Would Provide Florida Sinkhole Database Content, Form

On November 4, 2009, the Florida Department of Financial Services (“DFS”), Division of Consumer Services held a Rule Development Workshop on Proposed Rule 69J-9.001, entitled “Database of Information Relating to Sinkholes.”  

The DFS is required by law to consult with the Florida Geological Survey and the Florida Department of Environmental Protection to implement a statewide electronic database of sinkholes and related activity. 

If adopted, the proposed Rule would provide the form and content of the database, which may include:  standards for reporting and investigating sinkholes, requirements for insurers to report the receipt of sinkhole claims, past sinkhole claim activity and ground settling-related information.

With no public comments having been made at the Workshop, another public hearing will be scheduled to consider the proposed Rule.
