Mediation of Florida Property Insurance Claims Rules Proposed for Revision

Specifics of the mediation process for commercial residential, as well as residential property insurance claims are proposed for revision, the Florida Department of Financial Services’ Division of Consumer Services announced today, August 3, 2015.

If requested in writing and not deemed unnecessary by the Division of Consumer Services, a Rule Development Workshop will be held in Tallahassee on August 18, 2015 at 9:30 a.m.

Proposed revisions to the following Rules are intended to promote clarity and efficiency in the mediation of property insurance claims:

  • 69J-166.002         Mediation of Commercial Residential Property Insurance Claims
  • 69J-166.031         Mediation of Residential Property Insurance Claims

Amendments to both Rules would:

  • Cross-reference the new Rules for approval of mediators for the implementation of Section 627.7015, F.S., which sets forth an alternative procedure for resolution of disputed property insurance claims
  • Clarify that an insurer must make a claim determination before submitting a claim to mediation
  • Change the current period of 21 days allowed to resolve a claim before a mediation conference is held
  • Identify the Web site at which the mediation request form may be obtained
  • Specify that a mediation conference will be held within 15 miles of the insured property unless agreed otherwise by the parties
  • Provide various additional clarifications and minor revisions
