Florida Department of Financial Services Order Seeks to Clarify Public Adjuster Regulation Compliance Conflicts

In response to a November 19, 2009 Petition by Ameriloss Public Adjusting Corporation, the Florida Department of Financial Services (“DFS”) issued a Declaratory Statement today, February 16, 2010, that specifically addresses compliance conflicts between the provisions of public adjuster regulations effected in 2006, versus revisions in the public adjuster statutes that became effective in 2008.

Principally, this Declaratory Statement addresses issues related to the amount of fees that may be charged by a public adjuster, particularly with regard to reopened claims as a result of a catastrophe.

Any petition for review or appeal must be filed with the appropriate District Court of Appeal within 30 days. 

The Declaratory Statement issued by DFS today is attached for review.
