Uniform Mitigation Verification Inspection Form Statutory Updates To Be Considered at Florida Office of Insurance Regulation June 20, 2011 Rule Hearing

The Florida Office of Insurance Regulation (“OIR”) has scheduled a Rule Hearing for June 20, 2011 at 9:30 a.m. for the purpose of updating Form OIR-B1-1802, also known as the “Uniform Mitigation Verification Inspection Form,” to reflect 2010 statutory changes and other related issues.

The proposed revisions would effect the following:

  • Delete reference to “My Safe Florida Home” inspectors and replace with reference to home inspectors licensed under Section 468.8314, F.S. who have completed at least three hours of hurricane mitigation training and have completed a proficiency exam
  • Implement statutory changes that allow engineers and contractors to use employees with requisite skill, knowledge and experience to conduct inspections
  • Revise OIR-B1-1802 to incorporate reference to criminal penalties provided by laws for conducting false or fraudulent inspections

The OIR has determined that the proposed Rule would not have an adverse impact on small business, nor would it be likely to directly or indirectly increase regulatory costs in excess of $200,000 in the aggregate within one year after its implementation.  A corresponding Statement of Estimated Regulatory Costs was not prepared in reference to the proposed changes.

The June 20 hearing will take place at the OIR (116 Larson Building, 200 East Gaines Street, Tallahassee, Florida).  A Colodny Fass representative will attend and provide a report.
