  • Florida Division of Administrative Hearings Proposed Rule Hearing; 2:00 p.m.  Proposed revisions to procedural Rules for adjudication of workers’ compensation claims would strike unnecessary language concerning production of a certificate from claimant’s counsel concerning efforts made to identify any liens because the Rule already requires that such liens be identified.  To view the hearing notice, click here.

    • Florida Office of Insurance Regulation
      • For final adoption
        • Proposed amendments to Rule 69O-170.0155 would update and revise Form OIR-B1-1809, “Health Care Provider Certification of Eligibility,” for Personal Injury Protection (“PIP”) benefits to reflect statutory revisions as the result of HB 119.  The changes are technical in nature.  To view the hearing notice, click here.
        • Proposed amendments to Rule 69O-176.013 would finalize Emergency Rule changes to Form OIR-B1-1149, “Notification of Personal Injury Protection Benefits,” in accordance with statutory revisions resulting from HB 119. Form OIR-B1-1149 now reflects that PIP benefits are allocated for emergency medical treatment and a flat $5,000 death benefit. The Form was also amended to incorporate technical edits regarding fraud reporting and billing disclosures. To view the hearing notice, click here.
        • Proposed amendments to Rule 69O-149.003, “Rate Filing Procedures,” delete the Maximum Annual Medical Trend tables from the text of the Rule, provide the URL of the OIR’s Website on which the tables will be published and updated as needed, and would limit the use of streamlined rate increase filings to Medicare Supplement providers with fewer than 1,000 policyholders nationwide rather than to 1,000 policyholders in Florida.         • Proposed amendments to Rule 69O-137.004, “Report of Information by Health Insurers Required,” would update and revise the Gross Annual Premium Report form (OIR-B2-1094).
        • Proposed amendments to Rule 69O-148.001, entitled “Funding of Preneed Contracts,” would remove the $7,500 dollar cap on the amount of insurance that may be written, which conflicts with the $12,500 limit permitted under s.626.785, F.S.

  • Florida Hurricane Catastrophe Fund (“FHCF”) Proposed Rule Hearing; 9:00 a.m. 
    • Proposed amendments to Rule 19-8.029 would implement s.215.555(5), F.S., regarding the reporting by insurers of insured values under covered policies to the FHCF for the 2013/2014 Contract Year and would adopt the 2013/2014 Interim and Proof of Loss forms and Detailed Claims Listing Instructions. 
    • Proposed amendments to Rule 19-8.030 would adopt the 2013/2014 Exposure and Loss Reimbursement Examination Advance Preparation Instructions, as well as the 2013/2014 Interim and Proof of Loss forms

Tuesday, February 19

  • DWC Proposed Rule Hearing; 10:00 a.m.  Proposed repeal of Rule 69L-6.026, entitled “Periodic Reports,” which requires employers who are issued stop-work orders, where the assessed penalty exceeds $50,000, to file quarterly compliance reports with the DWC.  The DWC is now able to efficiently monitor such compliance through the use of their data systems, which renders the filing of such employer reports unnecessary.  To view the hearing notice, click here.
  • DWC Proposed Rule Hearing; 10:30 a.m.  Proposed repeal of Rule 69L-26.003, entitled “Computation of Time,” because guidelines allowing the DWC to initiate contact with an injured employee or their representative were made obsolete by 2002 statutory amendments.
