Florida Office of Insurance Regulation Rule Hearing re Unfair Discimination Because of Travel Plans 3/31/2006

Today the Office of Insurance Regulation (OIR) held a public hearing with regard to proposed Rule 690-125.003 relating to Unfair Discrimination Because of Travel Plans. The purpose of the public hearing was to discuss a revision that was made to the proposed Rule. The rule prohibits unfair discrimination in the sale or pricing of insurance based upon the insured’s travel plans.

No public comments regarding the revision to the proposed rule were taken.

OIR explained that currently there is proposed legislation on this same issue in the House (HB 299) and Senate (SB 764). An industry representative enquired whether the rule will be changed to conform with the legislation, if the legislation passes. OIR stated that the legislation, if passed, will be broader than the rule, but ultimately the rule will not conflict with the statutes. HB 299 and SB 764 are here and here.

Industry representatives requested that the record be kept open for written comments, and OIR agreed to keep the record open for 10 days.
