Florida Senate Debates Property Insurance Omnibus Bill This Morning; Updated Side-by-Side Analysis Included

With two versions of omnibus property insurance legislation pending in both the Senate and House of Representatives today, the final day of the 2010 Florida Legislative Session, Colodny Fass has prepared a side-by-side analysis of CS/CS/HB 447, AS AMENDED v. Senate AA (559146) to SB 2044  v. CS/CS/SB 2044, AS AMENDED.  

The analysis is attached for review.

Senate Amendment 559146 to House Amendment 203343, filed by Senator Garrett Richter on April 29, strikes a claim settlement practices provision regarding § 626.9744, F.S.; extends the moratorium on “use and file” for rate increases through December 31, 2011, rather than 2012; and strikes all provisions related to sinkholes, among other revisions.

Further, two floor amendments to SB 2044 were filed by Senators Charlie Justice and Dan Gelber that are considered hostile to the insurance industry.  

Senator Justice’s amendment would create a new cause of action for the adjustment of claims under F.S. 626.9541(i).

Senator Gelber’s amendment strikes the entirety of SB 2044 and adds the two-year extension of the suspension on use and file rates.

SB 2044 has been taken up by the Senate this morning and is being debated at this time.
