FLORIDA INSURANCE REGULATORY EVENTS   

 

    Monday, April 13

    • 11:00 a.m.–Florida Division of Insurance Fraud Rule Development Workshop.  Proposed amendments to Rule 69D-2.005, “Compliance and Enforcement,” would clarify the Rule, which provides that the Florida Office of Insurance Regulation “shall” conduct audits to determine insurance company compliance with anti-fraud laws and take appropriate action against insurers for failure to comply.  The amendment would change “shall” to “may” to comply with s.624.307, F.S., and would clarify that the Florida Department of Financial Services has the authority to take action for failure to comply.  To view the workshop notice, click here.

      • State Board of Administration
        • Request approval of the 2015-2016 Florida Hurricane Catastrophe Fund Reimbursement Premium Formula
        • Request authority to file Notices of Proposed Rule for Rule 19-8.028, “Reimbursement Premium Formula,” and Rule 19-8.010, “Reimbursement Contract.”

    • 9:00 a.m.–Florida Hurricane Catastrophe Fund (“FHCF”) Proposed Rule Hearing.  Proposed amendments to Rule 19-8.029, “Insurer Reporting Requirements,” would adopt the Data Call and applicable reporting requirements for the 2015-2016 FHCF Contract Year.  Proposed amendments to Rule 19-8.030, “Insurer Responsibilities,” would adopt the examination instruction forms applicable to the 2015-2015 Contract Year.  To view the hearing notice and proposed Rule text, click here.

    • 9:30 a.m.–Florida Department of Financial Services (“DFS”) Proposed Rule Hearing.  To view the hearing notice, click here.
      • Proposed repeal of Rule 69J-8.004, “Qualification and Certification of Neutral Evaluators,” because the standards for neutral evaluators are now in s.627.7074, F.S.
      • Subsection 69J-8.008(2), “Selection of Neutral Evaluator,” would be amended to require insurers to contact claimants within three business days of notice of a request for neutral evaluation, and to copy the DFS on the correspondence to the claimant. 
      • Subsection (9) of Rule 69J-8.008 would be added to impose a duty on neutral evaluators to disclose conflicts of interest within three business days of assignment. 
      • Subsection (5) would be added to Rule 69J-8.009, “Evaluation Process,” to require disclosure of professionals used by a neutral evaluator and related conflicts of interest.
