TEST Louisiana Department of Insurance Releases list of Proposed Bills for 2012 Legislative Session

The Louisiana Department of Insurance (“Department”) on February 28, 2012, gave a brief overview of several bills that are expected to be filed in the Louisiana State Legislature during the upcoming session.

Louisiana Insurance Commissioner Jim Donelan said nearly three dozen bills affecting various aspects of insurance will be filed.  The proposed 2012 Legislative package follows:

 

HB 193 relating to compensation of personnel employed by the Commissioner of Insurance to conduct examinations of insurers by state Representative H. Eugene Reynolds

HB 849 relating to reinsurance credits and accreditation requirements by state Representative Kirk Talbot

HB 160 requiring certain additional insurers to pay an annual financial regulation fee assessed by the Commissioner of Insurance by state Representative Harold L. Ritchie

SB 230 clarifying definitions and company action level events relative to risk-based capital for domestic insurers by state Senator Troy E. Brown

HB 150 relating to the minimum capital and surplus requirements for HMOs by state Representative Harold L. Ritchie

SB 205 relating to lowering the minimum capital and surplus requirement for capital insurers from one million dollars to five hundred thousand dollars and removing the prohibition from providing workers’ compensation and employee liability insurance by state Senator Dan “Blade” Morrish

HB 970 relating to insurance holding companies by state Representative Major Thibaut

HB 569 relating to terms relative to duties to report insurance fraud by state Representative Marcus L. Hunter

HB 359 relating to the section of insurance fraud within the Department of Insurance by state Representative Vincent J. Pierre

SB 204 includes Louisiana Citizens Property Insurance Corporation among the entities exempt from furnishing bonds in judicial proceedings by state Representative Vincent J. Pierre

SB 358 prohibiting the recovery of penalties in class action suits against the Louisiana Citizens Property Insurance Corp. by state Senator Dan “Blade” Morrish

HB 354 relating to registration and regulation of Professional Employer Organization by the Department of Insurance and the Louisiana Workforce Commission by state Representative Gregory Cromer

SB 297 relating to the sunsetting of all insurance policy forms every 5 years by state Senator Karen Carter Peterson

HB 186 providing relief to certain fees for HMOs by state Representative Mike Huval
