Florida House of Representatives Insurance and Banking Subcommittee Unanimously Approves Uninsured Motorist, Medical Malpractice Exemption Bills

A bill relating to uninsured motorist coverage was passed unanimously by the Florida House of Representatives’ Insurance and Banking Subcommittee (“Subcommittee”) today, February 13, 2013. Sponsored by State Representative Clay Ingram, HB 341 amends s. 627.727(9), F.S. to clarify that if a named insured signs a non-stacking waiver under uninsured motorist coverage, that waiver applies to all insureds under the policy.
During today’s meeting, no debate or public testimony on the bill took place. HB 341 will now proceed to the House Civil Justice Subcommittee, followed by the Regulatory Affairs Committee.
The Subcommittee also heard a Proposed Committee Substitute (“PCS”) for HB 335. This bill would exempt two new types of commercial insurance relating to medical malpractice insurance from the rate filing process.
With the exception of workers’ compensation forms, the PCS would exempt most property and casualty forms from the filing and approval process, as long as the forms are filed in an informational filing with the Florida Office of Insurance Regulation. Under the provisions of the PCS, the informational filing would be required to contain a certification that the form complies with all Florida laws and rules.
There was no discussion or public testimony on the PCS for HB 335. The Subcommittee passed it unanimously.
