Florida House Considers Insurance-Related Repealer Bills Today on Second Reading; Passage Expected on March 10

The Florida House of Representatives held Session for one hour today, March 9, 2010, during which it considered bills on second reading that will repeal obsolete or outdated provisions of law if passed.  Insurance-related bills heard on the Special Order Calendar and passed to third reading included:

HB 545 relating to Residential Property Sales by State Representative Pat Patterson (Identical SB 2190)

Repeals a provision of law requiring disclosures of residential property windstorm mitigation ratings to purchasers in wind-borne debris regions.  Effective Date: upon becoming a law.

HB 909 relating to the Florida Workers’ Compensation Joint Underwriting Association by State Representative Steve Crisafulli (Identical SB 2734)

Deletes an obsolete transitional requirement for specified Florida Workers’ Compensation Joint Underwriting Association policies.  Effective Date: July 1, 2010

HB 1015 relating to the Workers’ Compensation Administrator by State Representative Marlene O’Toole (Identical SB 1758)

Repeals provisions relating to the Workers’ Compensation Administrator to abolish this position. Effective Date: July 1, 2010

CS/HB 7023 relating to the Repeal of Obsolete Insurance Provisions by the General Government Policy Council and the Insurance, Business and Financial Affairs Policy Committee (Representative Patterson)

Deletes specified obsolete provisions of insurance law relating to the transfer of funds from the State Board of Administration to Citizens Property Insurance Corporation (“Citizens”); the Florida Automobile Joint Underwriting Association presuit notice; Citizens reporting; reporting of activities relating to Florida’s sinkhole information database; feasibility and cost-benefit study of the Florida Sinkhole Insurance Facility; matters related to affordability and availability of sinkhole insurance; as well as the effective date for the exclusion of windstorm and contents coverage.  Effective Date: July 1, 2010

HB 7025 relating to the Residential Property Structural Soundness Evaluation Grant Program by the Insurance, Business and Financial Affairs Policy Committee (Representative Patterson)

Deletes obsolete the unfunded Citizens residential property structural soundness evaluation grant program. Effective Date: July 1, 2010

HB 7027 relating to Prohibited Activities of Citizens by the Insurance, Business and Financial Affairs Policy Committee (Representative Patterson)

Repeals the prohibition against Citizens using specified amendments or transfers of funds for rate or assessment increase purposes. Effective Date: July 1, 2010

 

These bills are expected to be taken up by the House tomorrow and passed on third reading, whereupon they will be ready for consideration by the Senate.
