Florida Division of Agent and Agency Services Schedules May 9 Rule Hearing to Update Public Adjuster Rules

The Florida Department of Financial Services’ Division of Agent and Agency Services has scheduled a May 9, 2013 Rule Hearing on proposed amendments to Rule Chapter 69B-220, Florida Administrative Code, relating to public adjusters.

Proposed changes to Rule 69B-220.051, F.A.C., entitled “Conduct of Public Adjusters and Public Adjuster Apprentices,” would clarify the responsibilities and requirements of public adjusters and public adjuster apprentices, define the terms “direct supervision” and “adjusting services,” specify the terms and conditions of contracts, require the license number on advertisements, delete provisions that reiterate or paraphrase statutory materials and prescribe practices to ensure fair dealing between public adjusters and claimants.

The proposed changes to Rule 69B-220.201, F.A.C., entitled “Ethical Requirements for All Adjusters,” would update the code of ethics for all adjusters, delete provisions that reiterate or paraphrase statutory material, and clarify the responsibilities and requirements of all adjusters.

The proposed amendments would update these Rules within the Chapter and incorporate recent legislative changes to Part VI of Chapter 626, Florida Statutes.

The Notice of Proposed Rule has been filed with the Florida Department of State and will be officially published in the Florida Administrative Register on April 11.

If requested, the Hearing will be held on Thursday, May 9 at 10:30 a.m. in Room 116 of the J. Edwin Larson Building, 200 E. Gaines Street, Tallahassee, FL 32399.
