DFS Rule Hearing Report: Mediation of Commercial Residential Property Insurance Claims

A scheduled Florida Department of Financial Services (“DFS”), Division of Consumer Services hearing on proposed Rule 69J-166.002: Mediation of Commercial Residential Property Insurance Claims was not held on Wednesday, May 27, because no public requests for a hearing had been made.

The proposed Rule would establish a mediation program for resolving disputed commercial residential insurance claims to be administered by the DFS.  The proposed Rule would replace 69J-2.002, F.A.C., which is no longer needed, since the number of disputed commercial residential insurance claims being mediated through an outside vendor has significantly diminished.

The proposed Rule would require insurers to notify commercial residential policyholders of their right to request mediation of disputed claims.  It also would create procedures for a notice of the right to request mediation, assignment of mediators, payment for mediation, scheduling mediation conferences, and the conduct of the mediation conference.
