Commercial Property Joint Underwriters Association Rule Hearing Report

Jun 24, 2008

On Tuesday, June 24, 2008, the Florida Office of Insurance Regulation (“OIR”) scheduled a Rule Hearing on Rules 69P-2.001, and .002 relating to the Commercial Property Joint Underwriters Association.  To view the meeting notice and proposed Rules, click here.

Section 22 of House Bill 1A, which passed during the 2007 Special Session A, deactivated the Property and Casualty Joint Underwriting Association (“PCJUA”).  In accordance with that legislation, all policies in the PCJUA were assumed by Citizens Property Insurance Corporation.  Therefore, the PCJUA Purpose and Plan of Operation Rules need to be repealed.

A hearing regarding the repeal was not requested, and therefore one was not held.

For your review, we have included copies of the Rules scheduled to be repealed.

The items will be heard next by Financial Services Commission (“FSC”) for final approval.  A representative from Colodny Fass will attend the FSC meeting and provide a report on the proceedings.

Should you have any questions regarding this matter, please do not hesitate to contact Colodny Fass.
