DFS Rule Hearing

The Florida Department of Financial Services (“DFS”) Division of Workers’ Compensation has issued a Notice of Proposed Rule regarding Rule Chapter 69L-24:  Insurers’ Standards and Practices.

Rule Chapter 69L-24 is being amended to concurrently repeal and replace all existing Rules with new Rules that would establish guidelines to monitor, audit and investigate regulated entities for compliance with Florida laws regarding the timely payment of benefits to injured workers and medical bills, as well as timely data reporting.  Penalty guidelines also would be established for failure to comply with the statutory requirements.

Florida Title Insurance Study Advisory Council Meeting

The Florida Title Insurance Study Advisory Council will meet on Thursday, August 6, at 9:30 a.m., Room 110 of the Senate Office Building, The Capitol, Tallahassee. 

The Council will undertake a comprehensive examination of Florida’s title insurance system and make recommendations to the Governor and the Florida Legislature on the best course of action regarding title insurance for both consumers and the industry.  Issues that will be examined include the history of title insurance in Florida, the regulatory structure, ways to obtain meaningful data to develop title insurance rates, and other pertinent topics necessary to render sound public policy recommendations.  For more information on the Council, click here.

 

OIR Rule Development

The Florida Department of Financial Services, Office of Insurance Regulation (“OIR”) has issued a Notice of Rule Workshop regarding the following Rule:

The proposed Rule would adopt an Annual Report Card for authorized personal residential property insurers to be used by the Office of the Florida Insurance Consumer Advocate as required by State law.  The Annual Report Card would incorporate a form and a letter-grade scale that would evaluate each insurer on the following factors:

  • The number and nature of consumer complaints, stated as a market share ratio, and received by the Florida Department of Financial Services (“DFS”) against the insurer;
  • The disposition of all related complaints received by the DFS;
  • The average length of time for payment of claims by the insurer; and
  • Any other factors identified as helpful to policyholders in making informed choices about homeowner’s insurance.

This Rule Development Workshop has been rescheduled from July 8, 2009, and now will be held at the time, date, and place shown below:

  • 69B-241:  Penalty Guidelines for Bail Bond Agents

The purpose of the proposed Rule Chapter is to establish uniform guidelines to be utilized by the Division in penalizing bail bond agents for violating Florida’s Insurance Code.

OIR Rule Development

The Florida Office of Insurance Regulation has issued a Notice of Rulemaking Development regarding Rule 69O-170.0155, entitled “Forms.”

Because the My Safe Florida Home program has concluded and is no longer offering free home inspections or mitigation grants, the proposed Rule amendments would, in part, revise the following form:

  • OIR-B1-1655:  Notice of Premium Discounts for Hurricane Loss Mitigation would be revised to remove references to the My Safe Florida Home program.

Amendment of the following form also has been proposed:

  • OIR-B1-1802:  Uniform Mitigation Verification Inspection Form revisions would incorporate terminology commonly used in the construction industry to describe the construction features to be inspected and to require the inspector and homeowner to verify that the inspector actually conducted the inspection.
